Terms of Service

Effective Date: July 7, 2026

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and fonszi Kft. ("Fonszi," "we," "us," or "our"), governing your access to and use of the fonskiiand beloop mobile applications and their related web versions and services (collectively, the "Apps" or the "Services").

By downloading, accessing, or using either App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Apps.

These Terms currently cover fonskii and beloop only. Other Fonszi products (design plugins, developer tools, and libraries) are governed by their own separate terms.

1. Definitions

"Account" means a registered Fonszi user account used to access the Apps.
"Content" means any data you create or store through the Apps, such as workout configurations, session history, and profile information.
"Free Tier" means the no-cost, ad-supported version of an App.
"Pro" means a paid entitlement that removes advertisements and unlocks additional features, obtained either as a one-time lifetime purchase or a recurring subscription.
"App Store" means the Apple App Store or the Google Play Store, through which the Apps are distributed and purchases are processed.

2. The Apps

fonskii — a ski and altitude tracking application for iOS and Android that records altitude, speed, distance, and vertical, with maps, trail data, and optional real-time location sharing ("Buddy Sessions").
beloop — a workout timer application for iOS, Android, and the web, offering six timer modes (Tabata, EMOM, AMRAP, Interval, Countdown, and Stopwatch).

3. Account Terms

3.1 Registration

Using fonskii, and using beloop on mobile, requires a Fonszi Account. The web version of beloop can be used without an Account. When registering, you must provide accurate, current, and complete information and keep it up to date.

3.2 Authentication Methods

You may create or access your Account using:

Email and password (with email verification and password reset);
Sign in with Google (Android);
Sign in with Apple (iOS).

3.3 Account Security and Single-Device Sessions

You are responsible for keeping your credentials confidential and for all activity under your Account. To protect your Account and enforce Pro entitlements, the Apps use single-device sessions: signing in on a new device signs you out of the previous one. Notify us at dev@fonszi.com of any unauthorized use.

3.4 Account Deletion

You may permanently delete your Account and its associated data at any time from within each App (fonskii: Profile › Delete account; beloop: Settings › Delete account). Deleting your Account in one App does not affect your Account on the other. Fonszi may suspend or terminate your Account for violation of these Terms.

4. Subscriptions and Pricing

Each App offers a Free Tier and an optional Pro upgrade:

Current prices are shown in-app and on the applicable App Store at the point of purchase, in your local currency where available. Pro entitlements are managed through RevenueCat and processed by the App Store. App Store subscription terms, including auto-renewal, apply in addition to these Terms.

4.1 Auto-Renewal (Subscriptions)

Recurring subscriptions automatically renew at the end of each billing period at the then-current price unless cancelled beforehand through your App Store account. You can manage or cancel auto-renewal at any time in your App Store subscription settings.

4.2 Lifetime Purchases

A one-time lifetime purchase grants perpetual access to the Pro features of the applicable App as they exist at the time of purchase and as subsequently updated, without a recurring charge.

4.3 Price Changes

Fonszi may change prices at any time. For active subscribers, price changes take effect at the start of the next billing period, subject to the notice requirements of the applicable App Store. Continued use after a price change constitutes acceptance of the new price.

5. Payment and Billing

All purchases are processed by the Apple App Store or Google Play Store and managed via RevenueCat. Fonszi does not receive or store your payment card details. You agree to the payment terms of the applicable App Store. All prices are exclusive of applicable taxes unless otherwise stated; you are responsible for any taxes imposed by your jurisdiction except where Fonszi is legally required to collect them. Advertisements in the Free Tier are served by Google AdMob, which handles ad delivery and associated data collection under its own privacy policy.

6. Free Tier and Advertising

The Free Tier is supported by advertisements served through Google AdMob.
Advertisements are not displayed during an active workout (beloop) or an active tracking session (fonskii), where user focus or safety is a concern.
On iOS, an App Tracking Transparency prompt is presented before any advertising identifier is accessed; declining results in non-personalized ads only.
Upgrading to Pro removes all advertisements.
Fonszi may modify Free Tier features or limits at any time, with reasonable notice for material changes.

7. Cancellation and Refunds

Subscriptions must be cancelled through the App Store's subscription management interface; Fonszi cannot cancel App Store subscriptions on your behalf. Upon cancellation, you retain Pro access until the end of the current billing period. No pro-rated refunds are issued for partial periods.

Refunds for App Store purchases (including lifetime purchases) are governed by the refund policies of the Apple App Store or Google Play Store; to request a refund, contact Apple or Google directly through their standard refund process. Nothing in these Terms limits any statutory refund or withdrawal rights you may have under applicable consumer-protection law.

8. Acceptable Use

You agree to use the Apps only for lawful purposes and not to:

(a) Reverse engineer, decompile, or disassemble the Apps, except to the extent expressly permitted by applicable law;

(b) Attempt to gain unauthorized access to any Account, server, or system connected to the Apps;

(d) Circumvent Free Tier limits, Pro entitlement requirements, or any security or access-control measures;

(e) Upload or transmit viruses, malware, or other malicious code;

(f) Impersonate any person or misrepresent your affiliation with any person or entity;

(g) Use the Apps to build a competing product by systematically extracting features, data, or design.

Fonszi may investigate and take appropriate action, including removing Content and suspending or terminating Accounts, for violations of this section.

9. Intellectual Property

9.1 Fonszi's Intellectual Property

The Apps, including their software, designs, user interfaces, graphics, logos, and trademarks (including "Fonszi," "fonskii," and "beloop"), and all related intellectual property rights, are and remain the exclusive property of Fonszi. These Terms grant you only a limited, personal, non-exclusive, non-transferable right to use the Apps in accordance with these Terms.

9.2 Your Content

You retain ownership of the Content you create (such as workouts and session data). You grant Fonszi a limited, non-exclusive, royalty-free license to process, store, and transmit your Content solely to provide the Services to you.

9.3 Third-Party and Open-Source Components

The Apps include third-party libraries distributed under their own licenses (e.g., MIT, Apache 2.0). Those licenses govern the respective components and take precedence over these Terms with respect to that specific component. Map, weather, and trail data in fonskii are provided by third parties (including Google, Apple, Open-Meteo, and OpenStreetMap/Overpass) subject to their own terms.

9.4 Feedback

If you provide feedback or suggestions, you grant Fonszi a perpetual, irrevocable, royalty-free license to use and incorporate it without obligation to you.

10. Fitness, Health, and Safety

fonskii and beloop are fitness and timing tools, not medical devices. Measurement data (including altitude, speed, distance, vertical, and timing) is provided for informational purposes only and may be inaccurate. You are solely responsible for your safety while skiing, exercising, or otherwise using the Apps. Do not rely on the Apps for navigation, safety-critical, competitive-judging, or medical decisions. Consult a qualified professional before beginning any exercise program. Always remain aware of your surroundings and conditions; do not operate the Apps in a manner that distracts you from safe activity.

11. Privacy and Data Protection

Your use of the Apps is governed by our privacy policies. See the fonskii Privacy Policy, the beloop Privacy Policy, and the company-wide Fonszi Privacy Policy. By using an App, you consent to the collection and use of your information as described there. Certain third parties (including Apple, Google, RevenueCat, and Google AdMob) process data under their own privacy policies; Fonszi is not responsible for their practices.

12. Disclaimer of Warranties

THE APPS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FONSZI DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND WARRANTIES THAT THE APPS WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

FONSZI DOES NOT WARRANT THAT FITNESS TRACKING, ALTITUDE, TIMING, OR OTHER MEASUREMENT DATA WILL BE ACCURATE OR SUITABLE FOR ANY PARTICULAR PURPOSE, INCLUDING COMPETITIVE, MEDICAL, OR SAFETY-CRITICAL USE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS; IN THOSE JURISDICTIONS THE ABOVE APPLIES TO THE FULLEST EXTENT PERMITTED BY LAW.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FONSZI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE APPS, INCLUDING ANY PHYSICAL INJURY OR PROPERTY DAMAGE ARISING FROM THE USE OF FITNESS TRACKING OR TIMING FEATURES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FONSZI'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE APPS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FONSZI FOR THE APPLICABLE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS (USD $100.00). NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

14. Indemnification

You agree to indemnify and hold harmless Fonszi and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Apps, your violation of these Terms, your violation of any third-party right, or your use of fitness or timing features in a manner inconsistent with their intended purpose or safety guidance. This obligation survives termination of these Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Fonszi is incorporated, without regard to conflict-of-law principles, and without prejudice to any mandatory consumer-protection rights you enjoy in your country of residence.

16. Dispute Resolution

Before initiating any formal proceedings, you agree to contact us at dev@fonszi.com and attempt to resolve the dispute informally in good faith for at least thirty (30) days. This section does not deprive you of any right to bring proceedings in the courts of your country of residence where such right is guaranteed by mandatory law, nor of any right to seek injunctive relief to protect intellectual property.

17. Changes to These Terms

Fonszi may modify these Terms at any time. For material changes, we will post the updated Terms at fonszi.com/terms with a new effective date and, where you have an Account, provide reasonable advance notice (e.g., by email or in-app). Your continued use of the Apps after the effective date constitutes acceptance. If you do not agree, discontinue use of the Apps.

18. General Provisions

Severability. If any provision is held invalid or unenforceable, it will be modified to the minimum extent necessary, or severed, and the remaining provisions remain in effect.

Entire Agreement. These Terms, together with the applicable Privacy Policies and any third-party/open-source licenses, constitute the entire agreement between you and Fonszi regarding the Apps.

Waiver. Failure to enforce any provision is not a waiver of it.

Assignment. You may not assign these Terms without our prior written consent; Fonszi may assign them without restriction.

Force Majeure. Fonszi is not liable for delays or failures caused by circumstances beyond its reasonable control.

Apple & Google. These Terms are between you and Fonszi, not with Apple or Google. Apple and Google are not responsible for the Apps or for providing support or handling any claims relating to them, but are third-party beneficiaries entitled to enforce these Terms against you with respect to their platforms.
